OFFICIAL RULES

The Pear-up with Honor Society (”Sweepstakes”) is open to legal residents of the 50 United States, District of Columbia and Canada age 13 and older, with parent permission.  Employees of USA Pears (the “Sponsor”), its parent company, subsidiaries, affiliates, retailers, distributors, advertising and promotion agencies and any other individual or company involved in the development or execution of the Sweepstakes, and members of their immediate families (parent, child, sibling and their respective spouses) of same households, whether or not related, are not eligible to enter. All federal, state, and local laws and regulations apply. Sweepstakes governed by U.S. law. Void where prohibited by law.

Sweepstakes begins at on 9/1/09 and ends at 11:59 PM (ET) on 10/15/09 (”Sweepstakes Entry Period”).

To enter Sweepstakes: Complete Official Entry Form in its entirety, found at participating USA Pears retail locations and mail it, along with your proof of purchase for (3) three or more pounds of pears to the following address: Pear-up with Honor Society Sweepstakes, PO Box 495, Watertown, MA 02471. Mail-in entries must be postmarked between 9/1/09 and 10/15/09 and received by 10/31/09. No responsibility is assumed for entries that are illegible, lost, stolen, late, misdirected, damaged or postage due mail/entries. Mechanically produced or computer generated entries are void. All entries become property of USA Pears (”Sponsor”) and will not be returned or acknowledged. All incomplete or illegible entries will be void. Neither Strega Marketing Group nor the Sponsor assumes responsibility for third parties’ failure to act in accordance with Sponsor’s instructions pertaining to the implementation of the Sweepstakes.

CONSUMER DISCLOSURES: No purchase necessary to enter or win. You have not yet won. Ends at 11:59 PM (ET) on 10/15/09. One Grand Prize: Grand Prize: A trip for up to four (4) accompanying Honor Society for a Hollywood experience. Prize includes travel, accommodations and $1,500.00 (US) dollars to use any way you’d like. Fifty (50) Second Prize:  Autographed copy of Honor Society’s debut CD “Fashionably Late”.

Sponsor: USA Pears, 4382 SE International Way, Suite A, Milwaukie, OR 97222-4635. Prize is guaranteed to be awarded. Odds of winning depend on total number of eligible entries received during the Sweepstakes Entry Period.

Potential winner will be selected in a random drawing from among all eligible entries received during the Sweepstakes Entry Period. Random drawing will be conducted on or about 11/1/09 by an independent judging organization whose decision is final and binding. Winner will be required to complete and return an Affidavit of Eligibility and Liability and a Publicity Release (”Affidavit/Release”), within 14 days of date specified on notification, or an alternate winner will be selected.  Prize will be awarded on a date to be determined within sixty (60) days after winner verification. If Affidavit and/or a Release or a prize notification or prize is returned as undeliverable, it will result in disqualification, and the corresponding prize may be awarded to an alternate winner. If the winner is deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner’s parent or legal guardian who may be required to execute Affidavit/Release or any necessary paperwork/documents on minor’s behalf. Prizes are non-assignable or transferable. Entry and acceptance of prize constitute permission to use winner’s name, prize won, hometown and likeness for online posting and promotional purposes without further compensation, except where prohibited by law.

Entrants agree to these Official Rules and the decisions of the judges and the Sponsor, and release the Sponsor, its parent company, subsidiaries, affiliates, retailers, distributors, advertising and promotion agencies and any other individual or company involved in the development or execution of the Sweepstakes, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation, acceptance, use, misuse of prize. Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Sweepstakes or use or redemption of the prize. The Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of prize.
